Have Your Say - Special Wage Permit Policy

The Industrial Relations Commission (IRC) is seeking feedback on its draft Special Wage Permit Policy, developed to support the fair and consistent application of Special Wage Permits under s 125 of the Industrial Relations Act 1996.

Special Wage Permits may be issued to employees with a disability who are unable to earn the full wage rate prescribed by an applicable award or enterprise agreement.

What the Policy Covers

  • When a Special Wage Permit can be applied for
  • Who can apply and how applications are assessed
  • What evidence is needed to support an application
  • Conditions that may be imposed on permits, and how renewals are handled

Why This Policy Matters

This policy aims to ensure that permits are only issued where genuinely warranted, based on a fair and evidence based assessment of an individual’s ability to perform the work.

It also promotes inclusive employment opportunities while maintaining the integrity of industrial instruments and wage standards.
